WHAT IS BANKRUPTCY & HOW DOES BANKRUPTCY WORK?

Chapter 7: Liquidation

Chapter 7 can completely erase unsecured debts (e.g. credit cards, medical bills, unsecured loans, most civil court judgments, etc.). "Priority" debts (e.g. taxes, child support and government fines)  and "secured" debts (mortgages, car loans and debts where collateral is pledged) may be partially erased.  The goal in a chapter 7 case is to obtain a "discharge".  Debts that are primarily consumer are subject to a "means test", which is designed to determine whether the case should be permitted to proceed under chapter 7 or converted to a repayment plan under Chapter 13. Stone & Associates, as your bankruptcy lawyer, will provide a FREE consultation and prepare your bankruptcy petition. Call David Stone, Esq. at (843)422-9414, days, weekends and evenings for your FREE consultation today, or email DavidStoneLaws@gmail.com or skype david.stoneesq

Chapter 13: Reorganization

Chapter 13 can reorganize debt so that arrears can be paid over a five year period. It can also erase certain excess debt which is not capable of being paid over time. While Chapter 7 is generally preferred over Chapter 13, sometimes Chapter 13 affords advantages not available under Chapert 7.  Thus, Chapter 13 may allow for retaining a primary home, vacation or investment property or other items that may not be "exempt" under the South Carolina law or United States Bankruptcy Code. Stone & Associates will prepare your written bankruptcy Chapter 13 Plan together with other documents and demonstrate to the court how creditors can be paid over a five year period using future earnings while at the same time staying current on future debts as they come due. In Chapter 13 (and 7) contracts and leases (cars leases, apartments, equipment, etc.) can be rejected without penalty, thus shedding expenses which you may not be able to afford going forward. Stone & Associates, as your bankruptcy lawyer, will provide a FREE consultation and prepare your bankruptcy petition. Chapter 11: Business & Large Debtor Reorganization

Chapter 11 is similar to Chapter 13, however designed for the reorganization of complex businesses and consumer debtors with extensive assets of high value.  Chapter 11 allows for a debtors to retain control of business operations and assets, while simultaneously holding creditors at bay so as to allow for breathing room to reorganize operations.  With the "automatic stay" in place the debtor in possession can continue in business while reorganizing in an orderly manner.  Like Chapter 13, Chapter 11 can stop eviction, prevent utility termination, prevent creditors and suppliers from seizing inventory and asset. Stone & Associates, as your bankruptcy lawyer, will provide a FREE consultation and prepare your bankruptcy petition.
